From George Palaganas: On the Ammendments to the 1987 Constitution regarding Exact Number of Senators of 24 Senators elected every Simultaneous National and Local elections and 12 senators with four year terms
every LOCAL Elections.
The exact ammendments regarding these matter should be made public now since this question is one of the “constitutional blows” that is lurking in our midst
similar to the Ammendment to the Department of Education’s changing of name from DECS to DepEd. The local elections in 2007 where these 12 senators were
elected that will have four year terms includes NoyNoy who was one of the tailing end senators among the 12 in 2007. Hence, the remaining term for NoyNoy is not 3 years but his “elected office” as
senator will be vacated for 1 year only. The provisions on Senator’s seeking higher office during their term should also be reconciled.
There are two ways to ammend it, by signature campaign or by an Act of Congress. This is the job of Congress. Why should we be left out in technicalities
when we are only “learning” like everyone else among their constituents. And finally, the 4th state(mass media) should be “aware”of these errors or blunders
and proper erratum notices should be promulgated.
Mar Roxas is an elected senator in 2004 elections where he is the No.1 senator during that election. So, there is no problem for him to seek higher office as the seat’s term is co-terminus with that higher office.
